Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Tinstodo application (the "Service") operated by Tinstodo ("we," "us," or "our"). By creating an account or accessing the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use the Service.

1. Acceptance of Terms

By registering for an account, you represent that: (a) you are at least 13 years of age; (b) you have the legal capacity to enter into a binding agreement; and (c) you will comply with these Terms. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

2. Description of Service

Tinstodo is a personal task management application that allows registered users to create, organise, and track tasks, set due dates, and receive email reminders. The Service is provided through the website at tinstodo.com and any associated subdomains.

3. Account Registration and Security

To use the Service, you must create an account and verify your email address. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your password
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account at support@tinstodo.com

You may not share your account credentials with any third party. We reserve the right to terminate accounts that we reasonably believe are being accessed without authorisation.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Upload, transmit, or store unlawful, harmful, defamatory, or obscene content
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure
• Attempt to gain unauthorised access to any portion of the Service or any other system
• Scrape, crawl, or use automated means to access or collect data from the Service
• Reverse engineer, decompile, or disassemble any portion of the Service
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Send spam, phishing messages, or any other unsolicited communications through the Service

5. User Content

You retain full ownership of the tasks, descriptions, and other content you create within Tinstodo ("User Content"). By submitting User Content to the Service, you grant us a limited, non-exclusive, royalty-free licence to store and process that content solely for the purpose of providing the Service to you.

You represent and warrant that your User Content does not violate the rights of any third party, including intellectual property rights and privacy rights.

6. Intellectual Property

The Service, including its design, code, features, branding, and original content, is owned by Tinstodo and is protected by copyright, trademark, and other applicable laws. Nothing in these Terms transfers any intellectual property rights to you. You may not copy, reproduce, distribute, or create derivative works of the Service without our express written permission.

7. Service Availability

We strive to provide a reliable Service, but we do not guarantee that the Service will be available at all times, uninterrupted, or error-free. We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Email reminders are delivered on a best-effort basis. We are not responsible for missed deadlines resulting from undelivered or delayed reminder emails.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TINSTODO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF BUSINESS, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED $10 USD.

10. Children's Use

The Service is not intended for children under the age of 13. By creating an account, you confirm that you are at least 13 years old. If we discover that a user is under 13, we will terminate their account and delete any associated personal data in accordance with applicable law, including COPPA.

11. Termination

You may delete your account at any time from Account Settings → Danger Zone. We reserve the right to suspend or terminate your account immediately, without prior notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately and your data will be deleted as described in our Privacy Policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in New York County, New York. If you are a consumer in a jurisdiction that requires disputes to be resolved locally, this clause does not override your statutory rights.

13. Changes to Terms

We may revise these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we will notify you by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
